A fellow we’ll call “T” (who took the above photograph) writes:
Just saw this shiny new sign on the westernmost edge of McCarren. Is this even legally enforceable? I don’t think that if you install a structure like this on public property (ie: the sidewalk) you get to enforce who uses it. Anyhow, it’s a pretty gross gesture to others in the neighborhood: “Our wealthy tenants have so many meals delivered that we need an entire rack to accommodate the bikes. I’m sure the rest of you serfs don’t understand what that’s like, but we appreciate your compliance. Please go chain up against the nearest street sign.”
Is this legally enforceable? That’s an excellent question. One I have taken up with a few folks in the know.

UPDATE, 6:43 p.m.: Follows are a few responses I have received!
Needs a DOT revocable consent for street furniture.
There was another one of these “private bike racks” in the east village last year.
Gothamist got to the bottom of it. http://gothamist.com/2011/10/14/can_you_have_a_private_bike_rack_on.php
Quoth the DOT representative: “even if a permit is issued for installation, that does not mean the bike rack is for the exclusive use of the owner if it is installed on a public sidewalk.”
Public sidewalk = public bike rack.
So the next question becomes:
Will this ordinance be enforced?
Given the predilection for selective enforcement hereabouts, I for one am not terribly optimistic.

Hi Everyone,
As promised from last night’s OUTRAGE meeting, I have prepared a log sheet for people to document illegal truck traffic in preperation for the Illegal Truck Enforcement Task Force. Please make sure to take note of the date/ time, location, truck description including type and license plate number, and a description of what illegal activities you are witnessing. The idea is to have this documented in time for the Illegal Truck Enforcement Task Force spearheaded by OUTRAGE, which will be held on Thursday January 3rd. This is the first time we will have the 90 and 94th Precincts, DOT, DEC, DSNY, CB 1 Environment and Transportation, local businesses and other stakeholders sitting down to discuss enforcement of the numerous illegal garbage truck activities harming our health and safety. This is a big step in pressuring the City to take some action towards relief and it is our responsibility to give them evidence of how large the impact of these trucks have on our daily lives. Please pass the document sheet on to those who can help us to document. I will be collecting the information before the meeting on January 3rd so do your best to collect in the following weeks.
I have passed this sheet on to those who did not attend last nights meeting, but are well aware of the issues and would be able to assist us in this effort. Take pictures if you can and remember that all this will be given as documentation and evidence for why the police precincts and City agencies must take an active roll in this Task Force. Hey Folks
The Mark bar had an artist drop out, so I’ve been asked to hang a last minute art show. And to celebrate the Holidays we’re gonna having the First Annual Gift-A-Ganza Holiday Fair Featuring Arts, Crafts and Gifts made by the regulars of the Bar and the GSpot, including Mark Richards, Francis Christie, Carri Skoczek, Lisa Roman and Lindsey McCosh. Expect t-shirts, sock monkeys, jewelry, coffee mugs, and affordable art! I’ll be showing a mix of old and new works from my Roadwork Ahead series and my Great Vintage Race Car series.
The show will be up for the next month.
